The present Application under Section 528 of the
Bharatiya Nagarik Suraksha Sanhita, 2023 has been
preferred by the applicants – accused for quashing the
entire proceedings of Criminal Case No. 1056 of 2023,
“State vs. Israr and Others“, pending before the court of
Judicial Magistrate/IInd Additional Civil Judge (Junior
Division), Roorkee, District Haridwar under Sections 147,
148, 149, 323, 427 and 506 of the Indian Penal Code,
1860.
2. Heard Mr. Mohd. Safdar, learned counsel for the
applicants, Mr. Tumul Nainwal, learned Assistant

Government Advocate for the respondent no.1 and Mr.
Faizan Ali, learned counsel for the respondent nos. 2 and 3.
3. All the applicants are present in-person. They
are identified by Mr. Mohd. Safdar, Advocate.
4. Irfan, the respondent no.2-informant and Arif,
the respondent no.3-injured are present in-person. They
are identified by Mr. Faizan Ali, Advocate.
5. Both, the applicants and the private respondents
submitted that they have settled their private disputes
amicably and reached to a compromise pursuant to which,
they have filed a Compounding Application (IA No.01 of
2025) and affidavits. They submitted that they have filed
the compounding application and affidavits with their free
will and without any pressure. They have requested to
quash the entire proceedings of Criminal Case No.1056 of
2023.
6. Learned counsel for the State submitted that the
parties have settled their private disputes amicably,
therefore, the State has no objection to the submissions of
the applicants and the private respondents.
7. Considering the totality of the matter, this Court
is of the view that ends of justice would be met if the entire
proceedings of Criminal Case No. 1056 of 2023, “State vs.
Israr and Others“, pending before the court of Judicial

Magistrate/IInd Additional Chief Judicial Magistrate,
Roorkee, District Haridwar, are quashed.
8. Resultantly, the present Application filed under
Section 528 of the Bharatiya Nagarik Suraksha Sanhita,
2023 is allowed and the entire proceedings of Criminal Case
No. 1056 of 2023, “State vs. Israr and Others“, pending
before the court of Judicial Magistrate/IInd Additional Civil
Judge (Junior Division), Roorkee, District Haridwar, are
hereby quashed.
