Respondent Nos. 2 and 3.
4. The present application under Section 528 of the
Bharatiya Nagarik Suraksha Sanhita, 2023, has been
filed on behalf of the Applicant-Ranjeet Singh alias
Laddi against Respondent Nos. 1 and 2-Balraj Singh
and Manjeet Singh, respectively seeking quashing of
the charge sheet dated 16.04.2024, the summoning
order dated 06.01.2025 passed by the learned
Additional Chief Judicial Magistrate, Khatima, District
Udham Singh Nagar and the entire proceedings of
Criminal Case/Sessions Trial No. 10 of 2025, “State of
Uttarakhand vs. Ranjeet Singh alias Laddi and Others,”
for offence punishable under Sections 307, 323, and
504 of the Indian Penal Code, 1860, pending before the
Court of the learned Additional District and Sessions
Judge, Khatima, District Udham Singh Nagar.
5. Along with the present application under Section
528, a joint Compounding Application (I.A. No. 1 of
2025) has been filed and signed by the parties, duly
supported by their separate affidavits, wherein it is
stated that the parties have entered into a compromise
and request that, in this light, the matter may be
compounded.
6. The Coordinate Bench, vide order dated
23.05.2025, has noted the objections of the learned

State counsel.
7. The learned State counsel makes a statement
that the matter in which compounding or quashing of
the order is being sought relates to an offence under
Section 307, which defines an attempt to murder, and
that without knowing the previous criminal history, the
compounding/compromise shall not be considered.
8. As per the order sheet dated 23.05.2025, the
Coordinate Bench directed the petitioner/accused to
deposit the amount of Rs. 30,000/- within a period of
one week with the Trial Court concerned and to produce
the receipt of the same. It was further directed that the
parties shall appear before the Secretary, District Legal
Services Authority, Rudrapur, District Udham Singh
Nagar on 09.06.2025, who, in turn, would take their
Aadhaar Cards for identification and also verify and
authenticate the contents of the compounding
application by recording their statements. It was further
directed that counsels for the respective parties shall
also appear before the Secretary, District Legal Services
Authority, Rudrapur, District Udham Singh Nagar to
identify their clients. Further directions were made for
submitting the report of the learned Secretary, District
Legal Services Authority, Rudrapur, District Udham
Singh Nagar before the next date of listing.
9. Today, Applicant No. 1-Ranjeet Singh alias Laddis
is present in person before the Court and is duly
identified by Mr. Mani Kumar, Advocate. Respondent No.
2-Balraj Singh and Respondent No. 3-Manjeet Singh are
also present in person before the Court and are duly
identified by Mr. Manoj Bhatt, Advocate.
10. As per the First Information Report, which was
lodged by Respondent No. 2-Balraj Singh, it is alleged
that on 31.12.2023, while he was at home, due to a

mining dispute, there was a tussle between the parties.
With intent to hurt, the complainant/Respondent No. 2
Balraj Singh was fired upon with a firearm, and he
somehow saved his life by evading the bullet. As per
the FIR, there was no injury apparent resulting from
the firing. However, according to the medical report,
Respondent No. 2-Balraj Singh sustained an injury,
particularly a contusion over the left knee measuring
4x4x1 cm with tenderness, caused by some blunt
object, whereas the injury sustained by Respondent No.
3-Manjeet Singh is noted as “Linear Abrasion over right
nasal alae and crushed blood present in right nostril.”
11. The Court also interacted with both the
injured/Respondent Nos. 2 and 3. During the
interaction, they made a statement that they are
relatives and do not wish to pursue the matter any
further. They fairly conceded that they have no
objection if the compounding application is allowed.
12. Heard learned counsel for the parties and
perused the material available on record.
13. In light of the legal principles laid down by the
Hon’ble Apex Court in Gian Singh vs. State of
Punjab, (2012) 10 SCC 303, and Dimpey Gujral vs.
Union Territory of Chandigarh, Transfer Petition
(Criminal) No. 115 of 2012, decided on
06.12.2012, this Court holds that criminal proceedings
may be quashed if the matter has been amicably
settled between the parties and they are inclined to
restore peace and harmony.
14. Per contra, the learned State Counsel raised a
preliminary objection, stating that some of the offences
sought to be compounded are non-compoundable.
15. Considering the overall facts and circumstances of
the case, and as the parties are relatives, this Court is

of the view that the ends of justice would be met by
quashing the entire proceedings of Criminal
Case/Sessions Trial No. 10 of 2025, “State of
Uttarakhand vs. Ranjeet Singh alias Laddi and Others,”
for offences punishable under Sections 307, 323, and
504 of the Indian Penal Code, 1860, pending before the
Court of the learned Additional District and Sessions
Judge, Khatima, District Udham Singh Nagar.
16. Accordingly, the Compounding Application is
allowed. The entire proceedings of Criminal
Case/Sessions Trial No. 10 of 2025, “State of
Uttarakhand vs. Ranjeet Singh alias Laddi and Others,”
for offences punishable under Sections 307, 323, and
504 of the Indian Penal Code, 1860, pending before the
Court of the learned Additional District and Sessions
Judge, Khatima, District Udham Singh Nagar, are
hereby quashed.
17. The Criminal Miscellaneous Application filed under
Section 528 of the Bharatiya Nagarik Suraksha Sanhita,
2023, is accordingly disposed of.
