    The Court made the following Order: (perHon'ble Sh Justice R. Raghunandan Rao)

             The petitioner was subjected to assessment by the Commercial Tax

    Officer, No.lll Circle, Nellore, by treating the petitioner as an unregistered

    dealer dealing in the sale of cigarettes. The Commercial Tax Officer, No.lll

    Circle, Nellore, passed an assessment order, dated 14.11.2012, for the tax

    periods 2009-2010 & 2010-2011, assessing the petitioner           to   a total tax


    payable of Rs.85,30,249/-. Thereafter, the petitioner      was    served   with    a


    Demand Prior to Attachment of Land, in FORM NO-4, under Section 25 of the

    Andhra Pradesh Revenue Recovery Act, 1864, dated 13.03.2025, seeking to

    attach an immovable property, said to belong to the petitioner in Krishna

    Nagar in Nellore Municipal Corporation Jurisdiction, Nellore.


    2.       Aggrieved by these proceedings, the petitioner has approached this

    Court, by way of the present Writ Petition, contending that, the show-cause

    notice was not received by him before the impugned proceedings, dated

    14.11.2012, had been issued; the assessment proceedings, on 14.11.2012,

    were not received by the petitioner and as such, the petitioner cannot be held

    to be liable.



    3.       Ms. Grandhi Priyanka, learned counsel for the petitioner, would draw

    the attention of this Court to the contents of the assessment order, dated

    14.11.2012. The Commercial Tax Officer, No.lll Circle, Nellore, specifically
