1. Briefly stated, the facts of the petition are that on 31.07.2021, at about
03:00 pm, one Imran Khan (since deceased) was going to his village Daduwa
from his office on a motorcycle bearing registration no. DL9SU-0356. It has
been alleged that when he reached at Nagar Juice Corner Chauraha, within the
jurisdiction of PS Kotwali City, Ghaziabad, U.P., one truck bearing
registration no. UP87T-5268 (hereinafter referred to as offending vehicle),
came from Lal Kuan side at a very high speed and hit the aforesaid
motorcycle of the deceased with a great force. It has been further alleged that
the offending vehicle was being driven by its driver i.e. respondent no. 3 (R3)
herein, at a very high speed and in a rash and negligent manner without taking
necessary precautions at the time of the accident. Allegedly, above-said Imran
Khan fell down on the road after being hit by the offending vehicle and he
sustained grievous injuries. The injured was thereon immediately taken to
MMG Hospital, Ghaziabad, U.P. for initial treatment and he was subsequntly
referred to Yatharth Hospital, Gautam Budha Nagar, U.P., where he expired on
31.07.2021 itself. The postmortem was thereon conducted at mortuary of
