                    Writ Petition No.17860 of 2025

ORDER:

Heard learned counsel for the petitioner, learned Government

Pleader for Home appearing for respondent Nos.1 to 5, and with the

consent of the learned counsel appearing for the parties, the Writ Petition

is taken up for hearing and disposal at the admission stage.

2. Having regard to the manner of disposal of the Writ Petition at the

admission stage and the nature of lis involved, this Court is of the view

that notice to unofficial respondent No.6 is not necessary for adjudication

of the present Writ Petition.

3. The case of the petitioner, in brief, is that, respondent Nos.4 and 5

are interfering with the petitioner’s life and liberty and also involving

themselves in the civil disputes pending between the petitioner and the

unofficial respondent, which are the subject matter of a suit, vide

O.S.No.342 of 2023 and also the Writ Petition pending before this Court

and thus, the action of the respondents in interfering in the civil disputes

and also with the petitioner’s life and liberty, it is contended as illegal,

arbitrary without authority of law and also in violation of Articles 14, 21

and 300A of the Constitution of India.

4. Per contra, learned Government Pleader for Home appearing on

behalf of respondent Nos.1 to 5, while denying the writ averments, would

submit that one Raju had approached the respondents-authorities and

lodged a complaint on 27.05.2025 and based on the said complaint and

after causing preliminary enquiry thereinto, the authorities have registered

a case, vide Crime No.152 of 2025 dt.31.05.2025, wherein the petitioner is

arrayed as accused No.1.

5. Learned Government Pleader further submits that the respondents-

authorities, except conducting investigation into the aforesaid crime

registered, are not involving themselves in the civil disputes that may exist

between the petitioner and the unofficial respondent, which are claimed to

be subject matter of civil suit and also a Writ Petition pending on the file

of this Court.

6. The aforesaid submission made by the learned Government Pleader

for Home appearing for respondent Nos.1 to 5 is taken on record.

7. Having regard to the submissions made as above, and taking note

of the fact that based on a complaint made by one Raju, a case, vide

Crime No.152 of 2025 dt.31.05.2025 is registered against the petitioner,

this Court is of the view that the respondents-authorities are to be

directed to investigate into the aforesaid crime strictly in accordance with

law without interfering in the civil disputes that may exist between the

petitioner and the unofficial respondent herein.

8. Subject to above direction, the Writ Petition is disposed of. No

order as to costs.

9. Miscellaneous petitions, if any, pending in this writ petition shall

stand closed.
