The appellants were arraigned as accused
in FIR No.645 of 2023, dated 07.10.2023,
registered at Uthangarai P.S., District
Krishnagiri, Tamil Nadu for the offences
punishable under Sections 147, 148, 323, 324,
427 of the Indian Penal Code, 1860 (for
short, ‘IPC’) and Sections 3(1)(r), 3(1)(s)

Scheduled Tribe (Prevention of Atrocities)
Act, 1989 (for short, ‘SC/ST Act’).
The appellants were granted bail by the
Sessions Court vide order dated 12.01.2024.
On a statutory appeal filed before the High
Court under Section 14(A)(2) of the SC/ST Act
by the complainant, the High Court cancelled
the bail granted to the appellants vide the
impugned order for the alleged violation of
conditions which were imposed by the Trial
Court while granting bail as a subsequent
case, being Crime No.173 of 2024 was
registered against the appellants for the
offences punishable under Sections 294(b),
323, 324 and 506(2) of the IPC while they
were out on bail.
Heard learned counsel appearing for the
parties.
On a perusal of the impugned order, we
find that the High Court has failed to
consider the finding given by the Sessions

Court while granting bail that the parties
were embroiled in a property dispute and
counterblast FIRs were being filed in respect
of the same.
Taking into consideration the aforesaid
facts, we are inclined to grant bail to the
appellants.
Accordingly, the impugned order is set
aside and the appellants are granted bail on
terms and conditions to the satisfaction of
the Trial Court.
The appeal stands allowed, accordingly.
Pending application(s), if any, shall
stand disposed of.
