This is a private complaint filed by the complainant

against the accused for the offence punishable under

Section 138 of Negotiable Instruments Act.

2. The brief facts of the complainant’s case is as

under:

It is contended that, the complainant and the accused

are well acquainted with each other and in such

acquittance, the accused approached the complainant in

the month of March 2017 for the hand loan of Rs.12 lakhs

to meet his financial commitments. The accused was

working at a liquor company called Bacardi India Pvt. Ltd,

Bengaluru. Considering, the request of the accused, the

complainant has advanced Rs.10,50,000/- on different

intervals on the assurance that, the accused would return

the amount within six months. After the lapse of six months,
