This is a private complaint filed by the complainant

against the accused for the offence punishable under

Section 138 of Negotiable Instruments Act.

2. The brief facts of the complainant’s case is as

under:

It is contended that, the complainant and the accused

are well acquainted with each other and under such

acquittance, the accused has approached for the hand loan

of Rs.6 lakhs to meet his family commitments. Considering

the request of the accused, the complainant advanced Rs.6

lakhs on 21.03.2019 through cash. The accused on

acknowledging the loan amount, has also issued post dated

cheques bearing No.000003, 000004, 000005, dt:

17.03.2020 for Rs.2 lakhs each in total Rs.6 lakhs, drawn

on Kotak Mahindra Bank, Sarjapura Road, Jakkasandra,

C.C.No.3746/2021

Bangalore – 24, assuring to present after the time sought for

repayment. After the lapse of the time sought by the

accused, when the complainant presented the cheques

through his banker i.e., Corporation Bank, Basaveshwara-
