4. However, trial court has held that the application filed under

Section 340 of the Code shall be decided along with or after the

judgment. Admittedly, the said proceeding is pending before the

trial court.

5. Therefore, we are not inclined to entertain this Special Leave

Petition. Special Leave Petition is accordingly dismissed. Pending

application(s), if any, shall stand disposed of.
