Heard learned counsel for the petitioner and learned
APP for the State.
2. The petitioner is apprehending arrest in connection
with Nabinagar P.S. Case No. 179 of 2021 lodged on
05.08.2021 for the offences punishable under Section 147, 148,
149, 323, 337, 338, 307, 332, 333, 353, 427, 435, 504, 283, 188
of the Indian Penal Code read with sections 3, 4 of the
Prevention of Damage to Public Property Act, 1984.
3. As per the prosecution, FIR has been lodged against
76 named and 300-400 unknown accused persons against whom
there is allegation that they have indulged in violence and
started pelting stones and damaged the police vehicle. It is
further alleged that they have also created hindrance in the
discharge of official duty of police officials.
4. Learned counsel for the petitioner submits that the
petitioner is innocent and has committed no offence. Counsel

also submits that there is a general and omnibus allegation
against the present petitioner and other accused persons and
there is no specific act or overt act against the present petitioner.
Counsel further submits that the criminal antecedent of the
petitioner is clean. Counsel submits that several accused persons
have been granted bail by the Co-ordinate Bench of this Court
vide orders dated 14.07.2022 & 19.07.2022 passed in Cr. Misc.
Nos. 66121 of 2021 & 68863 of 2021.
5. Learned APP for the State opposes the prayer for
bail of the petitioner.
6. As such, considering the aforesaid facts and
circumstances, let the above named petitioner be released on
bail, in the event of arrest or surrender before the learned Court
below within a period of four weeks from today, on furnishing
bail bond of Rs.30,000/- (thirty thousand) with two sureties of
the like amount each to the satisfaction of the learned A.C.J.M.-
I, Aurangabad, in connection with Nabinagar P.S. Case No. 179
of 2021, subject to the conditions as laid down under Section
438(2) Cr.P.C.
