This application for bail under Section 483 of BNSS (439

Cr.P.C.) has been filed by the petitioner who has been arrested in

connection with F.I.R. No.104/2022, registered at Police Station

Phalodi, District – Jodhpur Rural (now District Phalodi) for the

offences under Sections 147, 148, 323, 324, 342, 307, 395, 397,

452, 482/149 & 120-B of the IPC and Section 25(6), 5/27 & 35 of

the Arms Act.

Heard learned counsel for the petitioner and the learned

Public Prosecutor. Perused the material available on record.

As per the case of the prosecution, the complainant

Jugalkishore has given a written report to the effect that he was

running a by name of M/s. Bangati Kala, Sachhiyay Maa Contex

since 2015. On 15.03.2022 at about 8:15 am three persons came

in a white coloured car in his office. Two persons were having

pistol and one person was having one knife. One person fired gun

shot at him with the pistol with the intention to kill. Thereafter

another person also fired at him. They snatched his gold chain

and threatened him. The accused persons also fired at his son

Ashok which hit in the knee of his left leg. Thereafter accused

persons fled away from the spot while firing.

The matter was investigated on the basis of CCTV footage

analysis and the secret information supplied by the secret

informer, accused Shaitan Singh @ Jokhim Bhara Banna,

Bhupendra Singh @ Bhaarat Singh, Hanuman Singh, Manish

Kumar Verma, Balveer Singh and Ganpat Ram have been

interrogated.

During investigation, it was found that Bhupendra Singh

made a plan of loot in the factory of the complainant and in his

plan, he added accused Shaitan Singh. Shaitan Singh procured

the weapon and cartridges from the accused Hanuman Singh who

gave one deshi Katta and cartridge to accused Shaitan Singh and

Balveer Singh. During investigation, it was further reveled that at

the time of incident, the present petitioner-accused Vikram Singh

was driving the Hundai I-20 car by which accused persons reached

the spot. Accused Ajay Singh, Hanuman Singh, Bhupendra Singh

and Shaitan Singh came out of the car while accused Prem Singh

and Vikram Singh were sitting in the car. Accused Shaitan Singh

and Hanuman Singh were having Deshi Katta and pistol in their

hands, while accused Bhupendra was having a knife.

Learned counsel for the petitioner argued that accused-

petitioner has been falsely implicated in the present case.

Learned counsel for the petitioner submitted that the co-

accused Balveer Singh to whom the fire arm injuries, which were

caused to the injured Ashok Kumar, were attributed, has already

been enlarged on bail by a Coordinate Bench of this Court vide

order dated 02.06.2023, passed in S.B. Criminal Misc. Bail

Application No.6630/2023.

He further submitted that the principal accused Bhupendra

Singh @ Bhaarat Singh who hatched the conspiracy of loot and the

co accused Hanuman Singh have also been enlarged on bail by a

Coordinate Bench of this Court vide order dated 02.06.2023,

passed in S.B. Criminal Misc. Bail Application No.6631/2023.

Learned counsel for the petitioner further submitted that the

co-accused Manish Kumar, Arjun Singh, Shaitan Singh @

Jokhimbanna have also been enlarged on bail by the Coordinate

Bench of this Court vide orders dated 05.07.2023, 01.08.2023 and

19.08.2023, passed in S.B. Criminal Misc. Bail Application

No.8113/2023, 7412/2023, 9868/2023 respectively.

Learned counsel for the petitioner further submitted that the

accused is in judicial custody since 13.05.2025 and the trial of the

case will take sufficiently long time, therefore, the accused-

petitioner may be enlarged on bail.

Per contra, learned Public Prosecutor vehemently opposed

the bail application and submitted that accused persons have

committed a serious crime of loot and assault on the complainant

and his son by firing with deshi katta and pistol. The present

accused was also a member of the team which assaulted the

complainant. the present petitioner-accused Vikram Singh was

driving the Hundai I-20 car by which accused persons reached the

spot. Accused Ajay Singh, Hanuman Singh, Bhupendra Singh and

Shaitan Singh came out of the car while accused Prem Singh and

Vikram Singh were sitting in the car. Accused Shaitan Singh and

Hanuman Singh were having Deshi Katta and pistol in their hands,

while accused Bhupendra was having a knife. Therefore, he prayed

that looking to the gravity of the offence, benefit of bail may not

be extended to the petitioner.

This Court finds that the present petitioner Vikram Singh was

driving the Hundai I-20 car by which accused persons reached the

spot and at the time of assault, the present petitioner Vikram

Singh was sitting in his car and no specific criminal act has been

attributed to him.

Having considered the rival submissions, facts and

circumstances of the case, without expressing any opinion on

merits/demerits of the case, this Court is inclined to enlarge the

petitioner on bail.

Consequently, the bail application under Section 483 of BNSS

(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner

Vikram Singh S/o Ishwar Prasad, arrested in connection with

F.I.R. No.104/2022, registered at Police Station Phalodi, District –

Jodhpur Rural (now District Phalodi), shall be released on bail, if

not wanted in any other case, provided he furnishes a personal

bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the

satisfaction of learned trial court, for his appearance before that

court on each & every date of hearing and whenever called upon

to do so till completion of the trial.
