1. The instant interim bail application has been filed under
Section 483 BNSS on behalf of the petitioner, who is in judicial
custody in connection with F.I.R. No.21/2021 dated 15.02.2021
registered at Police Station Borunda, District Jodhpur (Rural), for
the offences under Sections 8/15 and 29 of the NDPS Act.
2. Learned counsel for the petitioner submits that the petitioner
is suffering from the lung ailment on account of which, he requires
urgent medical treatment and thus, he deserves to be enlarged on
interim bail.
3. Learned Public Prosecutor has placed on record the factual
report dated 01.05.2025 along with the medical report dated
25.04.2025 of the concerned doctor of MDM Hospital, Jodhpur, in
which also, it is indicated that the petitioner is suffering from lung
ailment on account of which, he requires urgent treatment and
also he needs to be kept under observation.

4. Having heard and considered the submissions made by the
learned counsel for the petitioner as well as the learned Public
Prosecutor and taking a humanitarian view of the matter, this
court deems it fit to grant indulgence of interim bail of ’30 days’ to
the petitioner. The factual report dated 01.05.2025 along with the
medical report dated 25.04.2025, are taken on record.
5. Accordingly, the instant interim bail application is allowed. It
is ordered that the petitioner Vishna Ram Alais Vishnu son of
Gopa Ram, arrested in connection with F.I.R. No.21/2021 dated
15.02.2021 registered at Police Station Borunda, District Jodhpur
(Rural) shall be released on interim bail for a period of ’30 days’
from the date of his actual release, provided he furnishes a
personal bond in the sum of Rs.50,000/- alongwith two sound and
solvent sureties in the sum of Rs.25,000/- each (out of which, one
shall be furnished by a close family member of the accused-
petitioner) to the satisfaction of the trial court. The concerned jail
authority shall give the date of surrender to the petitioner.
