[1] Learned senior counsel for the petitioner KH. Tarunkumar is
present before court physically in the proceeding of PIL No.16 of 2025 and
wherein in this matter, learned AG Mr. Lenin Hijam is representing the State
of Manipur.
[2] However, the proceeding in PIL No.16 of 2025 is connected
with the proceeding in MC(PIL)No.23 of 2025.

[3] Whereas in the office noting of this PIL, it reveals as “to
release the 10% State Government Share and to fixed on 07.08.2025”.
[4] However, learned AG Mr. Lenin Hijam who is representing the
State of Manipur in these matters has facilitated a correspondence dated
28.03.2024 wherein it is indicating that the immediate Completion of the 22
years old Project “Construction of Senapati-Phaibung Road (128.90
Kms)”:- MP reference as received.
[5] Whereas, the learned AG in these matters has referred to the
2(c), (d) & (e) of the said correspondence which reads as thus:
(c) 91.17% work physically completed on ground.
(d) Execution of work stopped on ground for want of funds
since 2021 and road condition has deteriorated considerably
as no maintenance work has been carried out since 2021.
(e) BRO is not in a position to carry out balance works due
to non-release of fund by the Govt. of Manipur and non-
payment of Rs. 570.91 Lakhs on account of Pay and
allowances of BRO personal for work done on the road.
[6] Therefore, keeping in view the correspondence dated
28.03.2024 and so also the submissions made by the learned AG in these
matters are concerned, it is deemed appropriate to state that the BRO is
not in a position to carry out balance works but the works have already been
entrusted to the PWD, Government of Manipur and the Government of

Manipur is required to release 10% State share for completion of the
remaining works as the road condition is bad, it is in the limit of Senapati
District. However, in the preceding order sheet dated 23.07.2025 indicating
that the Secretary of Finance Department and Works, Government of
Manipur shall be present before the court physically but the learned AG in
these matters submitting that there shall be some budgetary session and in
that session, the Secretary of Finance Department and Works is present
and therefore, this submission which is made by the learned AG in these
matters is taken on record.
[7] However, keeping in view the letter dated 28.03.2024 and so
also the road condition of the road in the limit of the Senapati district of
Manipur are concerned, it is deemed appropriate that the State authority
concerned be directed to release 10% State share and to proceed in
accordance with law and so also in accordance with guidelines and norms
for completion of balancing works and if not, the matter will be viewed
seriously.
[8] Hence, these matters would be listed on 21.08.2025.
[9] In the meanwhile, it is deemed appropriate that the Secretary
Finance Department and Works, Government of Manipur shall be present
before this Court physically on the next date of hearing.

[10] The copy of this order shall be forwarded to the Chief
Secretary, Manipur for purpose of reference and information.
[11] However, keeping in view the submissions made by the
learned AG, it is deemed appropriate that the appearance of the Secretary
Finance Department and Works, Government of Manipur is exempted for
the day only.
