3. Pet it ioners have sought quashing of
F.I .R. No. 0385 of 2021, regist ered
against t hem for offence punishable
under Sect ions 406 & 384 I .P.C. in Police
St at ion Kashipur, Dist rict Udham Singh
Nagar.

4. Learned St at e Counsel, on
inst ruct ions, subm it s t hat t he
I nvest igat ing Officer has filed charge-
sheet against t he pet it ioners before t he
court concerned. Thus, he subm it s t hat
t he writ pet it ion has becom e infruct uous.

4. The said cont ent ion, however,
cannot be accept ed. The im pugned F.I .R.
is on record as Annexure No.1 t o t he writ
pet it ion. Perusal of t he F.I .R. reveals
t hat ingredient s of offences levelled
against t he pet it ioners are m ade out .

5. Hon’ble Suprem e Court in t he case
of M/ s Neeharika I nfrast ruct ure Pvt . Lt d.
Vs. St at e of Maharasht ra & ot hers,
report ed in AI R 2021 SC 1918, have laid
down param et ers for exercise of power
under Art icle 226 of Const it ut ion, in such
m at t ers.

6. Whet her t he allegat ions are t rue or
unt rue, would have t o be decided in t he
2024:UHC:9865

t rial.

7. I n such view of t he m at t er, t here is
no scope for int erference wit h t he
im pugned FI R while exercising
ext raordinary power under Art icle 226 of
t he Const it ut ion.

8. Accordingly, t he writ pet it ion fails
and is dism issed.
