2. Mr. S.C. Dumka, A.G.A. with Ms. S.B. Dobhal, B.H. for the State.

3. By means of the present writ petition, the petitioners have put to
challenge the F.I.R. No.0011 of 2025 dated 13.04.2025 under Sections 3/4
of Dowry Prohibition Act, 1961, 80 and 85 of B.N.S. 2023 registered with
Police Station Dharchula, District Pithoragarh.

4. It is contended by learned counsel for the petitioners that the deceased
committed suicide by hanging on 12.04.2025 in her matrimonial house at
Haat, Dharchula, District Pithoragarh.

5. It is contended by learned counsel for the petitioners that there was no
demand of dowry by the petitioners rather husband of the deceased-i.e.,
petitioner no.1 has even gifted mobile phone to the deceased-wife and his
mother-in-law.

6. He further submits that after marriage he has given a scooty to the
deceased-wife for her convenience and in such situation there is no question
of demand of dowry by the petitioners.

7. Per contra, learned State counsel submits that the deceased died of
unnatural death by hanging and in F.I.R. there are clear allegations of
demand of dowry at the hands of the petitioners; F.I.R. is a prompt one
written on 13.04.2025; the deceased allegedly committed suicide within a
period of less than three months of her marriage.

8. Having considered the rival submissions of learned counsel for the
parties, this Court is not inclined to interfere in the matter as the F.I.R.
discloses commission of serious offence of dowry death against the
petitioners.

9. Accordingly writ petition stands dismissed.
