t he FI R No.3 of 2024 dat ed 20.11.2024,
under Sect ions 118( 1) , 351( 3) and 352
of t he B.N.S. Act , regist ered wit h P.S.
Revenue Area Pakhura, Tehsil Ranikhet ,
Dist rict Alm ora.

4 . Learned counsel for t he pet it ioner
has lim it ed his argum ent t o t he ext ent
t hat t he invest igat ion agency should
com ply wit h t he guidelines given in
Ar n esh Kum a r Vs. St a t e of Bih a r
a n d a n ot h e r report ed in ( 2 0 1 4 ) 8
SCC 2 7 3 .

5 . Since t he offences under Sect ions
118( 1) , 351( 3) and 352 of t he B.N.S.
Act , carry a punishm ent m axim um t o
seven years, t herefore, before resort ing
t o any arrest a prior not ice under
Sect ion 35( 3) of t he B.N.S.S., 2023
( under Sect ion 41A of Cr.P.C.) is
necessary t o be issued t o t he pet it ioner.
Hence, it is provided t hat before t aking
any coercive m easures against t he

pet it ioner, t he I nvest igat ing Officer shall
abide by procedure given under Sect ion
35( 3) of t he BNSS Act , 2023 ( under
Sect ion 41A of Cr.P.C.) .

6 . Accordingly, t he crim inal writ
