2. Mr. S.C. Dumka, learned AGA along with
Ms. Sweta Badola Dobhal, learned Brief Holder
for the State.
3. By means of the present writ petition,
petitioners have put to challenge the orders
dated 17.11.2023 and 03.01.2024 passed by
learned CJM, Kashipur in the First Information
Report dated 26.10.2023 being FIR No.0551 of
2023, under Sections 147, 148, 149, 307, 323,
384, 504 & 506 IPC, registered at Police Station
Kashipur, District Udham Singh Nagar.
4. It is contended by learned Senior Advocate
appearing for the petitioners that both the
petitioners were granted anticipatory bail by
Apex Court vide order dated 03.05.2024. It is
further contended that by the impugned orders,
the application of the petitioners for recalling the
order dated 17.11.2023, whereby 82 proceedings
were launched against the petitioners has not
been considered, rather the orders have been
passed under Section 83 of the Cr.P.C.
5. Issue notice to the respondent no.3,

returnable within four weeks.
6. Steps to be taken within a week.
7. List on 17.09.2025.
8. In the meantime, respondents may file
counter affidavits to the writ petition.
