2. Mr. S.S. Chauhan, learned Deputy A.G. along with Mr.
B.C. Joshi, learned A.G.A. for the State.
3. Mr. Neeraj Garg, learned counsel for respondent
no.3/Caveator.
4. By means of the present writ petition filed under
Article 226 of the Constitution of India, the petitioner has
challenged the First Information Report (FIR) being Case
Crime No. 0011 of 2025 dated 20.03.2025, registered under
Sections 120-B, 420, 467, 471, 504 & 506 I.P.C., at Police
Station Laxman Jhula, District Pauri Garhwal along with a
prayer for other ancillary reliefs.
5. Learned counsel for the petitioners would submit that
the petitioners are innocent and have been falsely
implicated, and therefore the FIR should be quashed.
6. Learned counsel for respondent no.3/Caveator opposes
this claim, stating that the petitioner has not come with
clean hands, as they have not disclosed several other
pending criminal cases against them, in some of which
charge sheets have been filed and some are still under
investigation. He seeks time to file a counter affidavit.
7. In the interest of justice, two weeks’ time is granted to
learned counsel for respondent no.3/caveator to file a
detailed counter affidavit.
8. List this case on 08.07.2025 to consider the
application for interim relief.
9. Meanwhile, the State counsel may also file a counter
affidavit, if needed.
