Vijay Bhandari, learned Brief Holder for the State.
3. Mr. Faizan Ali, learned counsel for the respondent
no.3.
4. The present writ petition (criminal) under Article
226 of the Constitution of India is moved on behalf of the
Petitioner, Noor Hasan S/o Mehaboob against the
Respondents amongst whom, the Respondent no.3, Satbir
Singh S/o Shri Ram Chander is, as per the F.I.R., said to
be the name of victim/complainant, who had been duped
of the money in regard to some land deed; the present
writ petition comes with the prayer to quash the
impugned F.I.R. dated 09.06.2024 registered as FIR/Case
Crime No.0375 of 2024 under Sections 120-B, 420, 467,
468, 471 & 506 of IPC, Police Station – Kotwali
Roorkee, District Haridwar.
5. The Petitioner, Noor Hasan S/o Mehaboob and
Respondent no.3, Satbir Singh S/o Shri Ram Chander are
present before this Court, who are identified by their
respective counsel.
6. Learned counsel appearing on behalf of the
petitioner makes a statement that parties have come into
the term of compromise and in this regard, Compounding
Application (IA No.01 of 2025) is also annexed with the
present writ petition (page no. 24), supported with the
affidavits of the parties and signatures of the parties
concerned; the said application is being endorsed by the
learned counsel for the Petitioner and Respondent no.3,
Ms. Sadaf Gaur, Advocate and Mr. Faizan Ali, Advocate
respectively.
7. However, learned State counsel objects the present
compounding application with the contention that
throwing light on the FIR, whereby one Anoop Singh S/o
Shri Rangiram R/o Prem Nagar, Kakroi Road, District
Sonipat, Haryana is mentioned and as per FIR, who is
also said to be the dupe of the money regarding some
land deed but he has not been impleaded as a necessary
party in the present matter.
8. In the considered view of this Court that the matter
needs deliberation.
9. Accordingly, the present writ petition is admitted if
the petitioner impleads Anoop Singh as a necessary party
only thereafter, the present petition shall be heard.
10. Petitioner is directed to implead necessary party
within a week.
11. List this matter on 01.09.2025.
12. Meanwhile, objections, if any, to be filed by the
respondents.
