2. This is defendant ‘s pet it ion
challenging t he order dat ed 07.09.2024
passed by learned t rial court . By t he said
order, learned t rial court had allowed t he
delay condonat ion applicat ion and also
t he rest orat ion applicat ion filed under
Order 9 Rule 9 of CPC.

3. According t o pet it ioner, in t he
peculiar fact s and circum st ances of t he
case, delay could not have been
condoned by learned t rial court , wit hout
not ice t o t he pet it ioner.

4. This Court is not im pressed by t he
said subm ission. There was delay of only
four m ont hs in filing t he rest orat ion
applicat ion. Since delay was sufficient ly
explained and it is set t led principle of law
t hat lis should be decided on m erit and
not on t echnicalit y, t herefore, t he
discret ionary order passed by t rial court ,
of condoning t he delay, cannot be
int erfered wit h under supervisory
j urisdict ion under Art icle 227 of t he
Const it ut ion.

5. Thus, t here is no scope for
int erference in t he m at t er. Accordingly,
writ pet it ion fails and is hereby
dism issed.
