petitioner and Mr. P.C. Bisht, learned Additional
Chief Standing Counsel assisted by Ms. Rajni
Supyal, learned Brief Holder for State of
Uttarakhand.
2. Petitioner is serving as Inspector in Civil
Police. According to him, a meeting of
Departmental Promotion Committee (DPC), was
convened on 19.12.2024; however, his claim was
not considered in said meeting, while juniors to
him were considered for promotion to the post of
Deputy Superintendent of Police.
3. By means of this writ petition, petitioner
has sought following reliefs:-
“Issue a writ order or direction in the
nature of mandamus directing the respondent
no. 2 to consider the candidature of the
petitioner for promotion on the post of the
Deputy Superintendent of Police considering
the seniority of the petitioner in feeder cadre
post as per provision 11 of the Notification
dated 23.09.2004 (Annexure No. 01 to this
writ petition).”
4. Learned counsel for petitioner submits that
petitioner is due to retire on 31.01.2025, and if
his claim for promotion is not considered now,

then he will lose the right to be considered for
promotion forever.
5. Having regard to the facts of the case, we
dispose of the writ petition by permitting
petitioner to make representation to the Secretary
Home, Dehradun.
6. If petitioner makes representation by
24.12.2024, decision thereupon shall be taken by
the Secretary Home, Dehradun, within two
weeks thereafter.
