1. Delay condoned.
2. We are satisfied that the review petitioner was prevented by sufficient
cause from appearing before this Court on 19 th July, 2023 when Transfer Petition
(Criminal) No. 428 of 2023 was allowed by directing transfer of the proceedings
arising out of the complaint lodged by the review petitioner under Section 200
of the Code of Criminal Procedure, 1973 for the offences under Sections 352,
323, 386, 389, 420, 504, 506 and 34 of the Indian Penal Code, 1860 bearing
PCR No. 10658 of 2022 titled “Yashwant Kumar vs. Surbhi Singh & Ors.” from
the Court of the Chief Metropolitan Magistrate at Bengaluru to the Court of the
Sub-Divisional Judicial Magistrate, Gaya, Bihar.
3. The order dated 19th July, 2023, accordingly, stands recalled and Transfer

4. Accordingly, the review petition stands allowed. Pending interlocutory
applications therein stand disposed of.
5. The review petitioner has invited our attention to the memorandum of
agreement dated 10th October, 2023 executed by and between the parties
before the Patna High Court Mediation Centre. The terms of agreement reveal
handing over a draft of Rs. 15,00,000/- (Rupees fifteen lakh) only in favour of
his wife, Surbhi Singh (petitioner no.1 in the transfer petition) towards full and
final settlement of all claims by the review petitioner.
6. It was also agreed that upon full and final settlement of the financial claim
of the petitioner no.1 in the transfer petition, both parties will withdraw the
cases and counter cases filed, immediately.
7. In view of such memorandum of agreement, we direct further notice to be
issued to Surbhi Singh, petitioner no.1 in the transfer petition, as well as the
others, returnable in four weeks.
8. Proceedings bearing PCR No. 10658 of 2022 titled “Yashwant Kumar vs.
Surbhi Singh & Ors.” pending before the Court at Gaya shall remain stayed until
further orders.
