                                                 Date of Order: 07.05.2025

Yatra Vs. State of Meghalaya & Ors.

                 Hon'ble Mr. Justice H. S. Thangkhiew, Judge

                                      Mr. I. Kharmujai, Adv.
                                      Ms. T. Pohlong, Adv.

For the Respondent(s) : Mrs. T. Yangi B, AAG with

Mr. H. Abraham, GA (For R 1-5)

Mr. C.C.T. Sangma, Adv. (For R 6-8)

By the order dated 14.08.2024, when the matter was taken up by
this Court with regard to the grant of No Objection Certificate for
conducting the annual pilgrimage to Krem Mawjymbuin, Mawsynram,
it was directed that the Deputy Commissioner, East Khasi Hills District
propose the names of the entities and persons or stakeholders who were
to constitute the Committee, to examine the matter and to arrive at a
solution that is acceptable to all.

It appears that thereafter a Notification was issued on 21.08.2024,
whereby the Deputy Commission instead of proposing the names to be
constituted for the Committee, had issued a Notification whereby the
members of the Committee were notified along with terms of reference.
The same it is noted was objected to by the counsel for the petitioner at
that time as they were not represented in the said Committee, and
objections were thereafter filed. The matter thereafter on the substitution
of the counsel for the respondents Nos. 6, 7 & 8, and after filing of
affidavits, has not gone forward.

Mrs. T. Yangi B, learned AAG assisted by Mr. H. Abraham,
learned GA for the respondents Nos. 1 to 5, has also submitted that there
has been no decision arrived at, or any further meetings of the said
Committee.

In this backdrop, therefore this Court considers it expedient for the
ends of justice, that a fresh Committee be constituted in terms of the order
14.08.2024. In this regard, the Deputy Commissioner is to propose the
names for consideration before this Court, for re-constitution of the
same. The same shall be complied within a period of 10(ten) days.

List this matter on 27.05.2025.
