Heard Mr. Ajoy Pebam, learned counsel appearing for the

appellant/convict and Mr. Y. Ashang, learned Sr. counsel appearing for the

respondent.

This Court vide order dated 19.09.2024, while upholding the

conviction order dated 30.11.2018 of Ld. Special Judge (POCSO), Bishnupur

passed the following order:

“6. Having heard the learned counsel appearing on behalf of the
parties and perused the material available on the record and whilst
upholding the order of the conviction dated 30.11.2018; I consider
it appropriate in the extenuating circumstances elaborated
hereinabove to modify the order of the sentence dated 10.12.2018
only to the extent that the same shall be the period already
undergone by the appellant and he shall be enlarged from custody,
if not wanted in any other case, subject to the payment of fine
awarded to the victim in the sum of Rs. 5,000/- (Rupees five
thousand) within a period of 2(two) months from the date of his
release.

7. The Member Secretary, Manipur State Legal Services Authority
(MASLSA) is also directed to furnish a report in relation to the
compensation amount of Rs. 50,000/- (Rupees fifty thousands)
directed to be paid to the victim from the “Financial Assistance and

Support Service to Victim of Rape : A scheme for Restorative
Justice” on the next date of hearing.”

The learned counsel for the appellant/convict submits that as

per direction of this Hon’ble Court he was ready to pay the ordered amount

of Rs. 5000/- (Rupees five thousand) to the victim but he could not contact

with the victim till now, and as such requested to allow him to deposit the

said amount of Rs. 5000/- through the Registry of this High Court which is

not objected by Mr. Y. Ashang, learned Sr. counsel appearing for the State

respondent.

Accordingly, the convict/appellant is directed to deposit the

ordered amount of Rs. 5000/- to the account of the Registrar General of

this High Court within 2(two) weeks.

As per direction given at para 7 of the order dated

19.09.2024, this Court directed the Member Secretary, Manipur State Legal

Services Authority (MASLSA) to furnish a report in relation to the

compensation amount of Rs. 50,000/- (Rupees fifty thousand) to be paid to

the victim from the “Financial Assistance and Support Service to Victim of

Rape : A scheme for Restorative justice” on the next date of hearing.

Ld. Member Secretary, MASLSA submits a report regarding

the matter on 08.11.2024, in that he was informed by the Director (Social

Welfare), Govt. of Manipur that a sum of Rs. 2,00,000/- (Rupees two lakh)

only was deposited as one time financial assistance in the bank account of

victim’s uncle namely Khwairakpam Brojen singh on 30th December, 2021.

Accordingly, it is agreed and decided that direction given at

para 7 of the order dated 19.09.2024 is complied with.

With the above direction this Crl. A No. 7 of 2023 is disposed

of.
