This is a private complaint filed under section 200 of

Cr.P.C., against the accused for the offence punishable under

section 138 of the Negotiable Instruments Act.

02.The brief facts of the complaint is as under:

The complainant and accused are known to each other

since more than ten years. The accused has availed a hand

loan of Rs.7,50,000/- in the second week of March – 2019

from the complainant to meet his business and financial

commitments and promised to return the same within 3

months. After repeated demands made by complainant, to

discharge said liability, accused has issued a cheque bearing

No.660733 dated 24-06-2019 for Rs.7,50,000/-, drawn on

Indian Overseas Bank, Sunkadakatte branch, Magadi Main

Road, Bengaluru, in favour of the complainant. The

complainant presented said cheque for encashment through

his banker Axis Bank, Koramangala Branch, Bengaluru. The

cheque is returned unpaid with bank endorsement dated 09-

07-2019 showing cheque is dishonoured for the reason

“Funds Insufficient”. Thereafter, the complainant has got

issued legal notice to the accused through his counsel on 07-

08-2019 by way of R.P.A.D., and the same was served.
