Heard Mr. Anil Kumar Sinha, learned counsel for the

petitioner and Mr. Binod Kumar No. 3, learned APP for the

State.

2. Petitioner seeks regular bail in connection with

Roshanganj (Bankebazaar) P.S. Case No. 25 of 2020 dated

19.02.2020 registered for the offences punishable under sections

147, 148, 149, 120B, 121A, 124A and 427 of the Indian Penal

Code, sections 3 and 4 of the Explosive Substances Act, and

sections 10, 13, 16, 18 and 20 of the Unlawful Activities

(Prevention) Act and section 17 of the C.L.A. Act.

3. The main submissions advanced by petitioner’s

counsel are that though the instant matter relates to serious

occurrence of exploding a Government school allegedly

committed by the extremists, however, against this petitioner,

there is no material or evidence to connect him to the alleged

occurrence and he has been made accused mainly on the basis

of some secret information given by the Government agency,

co-villagers and local press reporters but during the course of

investigation, none of them has specifically revealed the name

of this petitioner as being involved in the alleged explosion. It is

further submitted that a group of 31 named and 30 to 40

unnamed extremists is alleged to have committed the alleged

occurrence of exploding the school building, who are said to

have been led by the main co-accused Sandeep Yadav @ Vijay

Yadav and any specific role of this petitioner in the commission

of the alleged occurrence has not been revealed in the FIR. It is

lastly submitted that the petitioner has been languishing in jail

since 18.11.2024 and has fair and clean antecedent.

4. Though learned APP for the State has opposed the

prayer of the petitioner but after perusing the case diary, he

accepted that there is no statement of any witness under section

161 of Cr.P.C., in which the name of this petitioner has been

revealed in the alleged occurrence.

5. Heard both the sides and perused the FIR and the

case diary of this case. Though the instant matter relates to

serious offences relating to exploding of the Government school

building, which is said to have been committed by a group of

more than 60 persons of an extremist organization and the

petitioner’s name also find place in the FIR but the basis of

making him an accused, is merely on some sources but during

the course of investigation, the police failed to bring the sources

in the form of evidence, so, in view of this fact as well as

considering the petitioner’s fair and clean antecedent and also

completion of investigation against him, this Court is inclined to

release him on bail. Accordingly, let the petitioner named-above

be released on bail on furnishing bail bond of Rs. 20,000/-

(Rupees Twenty Thousand) with two sureties of the like amount

each to the satisfaction of the court concerned in connection

with Roshanganj (Bankebazaar) P.S. Case No. 25 of 2020, on

the condition that if the trial court is going to proceed with trial

of the petitioner, then he will be released after framing of

charges upon him, if the charges are not framed for any legal

reason in next one month then the petitioner shall be released as

per above order.
