1. Leave granted.

2. The appellant seeks enlargement on bail in FIR

No.680/2021 under Sections 21, 25 and 29 of the NDPS Act

registered at Bhalswa Dairy Police Station, Delhi on

21.09.2021.

3. The allegations are that one Imran in his disclosure

statement stated that heroine which was recovered from him

was supplied by the appellant. Thereupon, a raid was

conducted and the appellant was apprehended. 260 grams

heroine besides a cash amount of Rs.26,40,000/- was

allegedly recovered from the appellant. He was arrested at

the spot. The investigation qua the appellant was completed

and chargesheet was filed in March, 2022, though we are

informed that a supplementary chargesheet is likely to be

filed against the appellant’s co-accused. Meanwhile, the

trial has also commenced and out of 17 witnesses, 7 have

been examined thus far. The fact, however, remains that the

appellant has been in custody for more than 3½ years. The

conclusion of trial will take some time, more so, when a

supplementary chargesheet is likely to be filed against the

appellant’s co-accused thereby ostensibly increasing the

number of prosecution witnesses.
