1. In the instant petition, petitioners have invoked the jurisdiction of this
Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita
(BNSS), 2023 thereby challenging the proceedings initiated on the
basis of an FIR bearing No. 38/2022 registered by Police Station,
Karnah under Sections 13, 18, 20, 23, 39 of Unlawful Activities
(Prevention) Act, 1967; Sections 8/21-29 of the Narcotic Drugs and
Psychotropic Substances Act, 1985; and Sections 3/5 of the Explosive
Substances Act, 1908. Petitioners are also seeking quashment of the
challan presented before the learned court of Additional Sessions
Judge (Designated Special Court under Section 22 of the NIA Act).
