Mr. Shubham Pandey, learned counsel for the applicant.
2. By means of the present C528 application, applicant has
put to challenge the summoning and cognizance order dated
01.08.2024, passed by learned Additional Chief Judicial
Magistrate, Ramnagar in Criminal Complaint Case No.151 of
2024, under Section 138 of the Negotiable Instruments Act,
1881, in Firm Garg Electricals vs. Firm Ekaant Corbett Krayi
& others, with a further prayer to quash the entire proceedings
of the aforesaid criminal complaint case.
3. It is the contention of learned counsel for the applicant
that applicant is a partner along with respondent no.3 to the
extent of 50% partnership in Ekaant Corbett Krayi, Ramnagar.
He further contends that the cheques of the applicant as well as
the respondent no.3 are kept in the Firm for the purpose of
business transactions. He also contends that he never issued any
cheque to the respondent no.1-Firm M/s Garg Electricals, and
therefore, proceedings against the applicant cannot be initiated.
4. Issue notice to the respondents, returnable within four
weeks.
5. Steps to be taken within a week.
