Central govt. said that the constitutions of Pakistan, Afghanistan and Bangladesh provide for a specific state religion. As a result, many persons belonging to Hindu, Sikh, Buddhist, Jain, Parsi and Christian communities have faced persecution on grounds of religion in those countries. Many such persons have fled to India to seek shelter and continued to stay in India even if their travel documents have expired or they have incomplete or no documents.
On 13 Dec 2019, President Ram nath Kovind gave his assent to the Citizenship (Amendment) Bill, which now became an act. The aim is to give, citizenship to refugees. This act’s purpose is to give Indian citizenship to illegal migrants of Hindu, Sikh, Christain, Jain, Buddhist and Parsi of Bangladesh, Pakistan, Afghanistan. One who entered into India on or before the 31st day of December, 2014.
64 year old Indian citizenship Law prohibits illegal immigrants from becoming Indian citizen. Whereas CAB empowers the Central Government to exempt the said migrants from the adverse penal consequences of the Passport (Entry into India) Act, 1920 and the Foreigners Act, 1946 and rules or orders. It was mandatory to live or work for federal govt. at least 11 years, which is being reduced to 5 years.
Nothing in this section shall apply to tribal area of Assam, Meghalaya, Mizoram or Tripura as included in the Sixth Schedule to the Constitution and the area covered under “The Inner Line” notified under the Bengal Eastern Frontier Regulation, 1873.’
This Act is a violation of Art.14 as it discriminates on the basis of religion. Increase in population will lead to increase in crime rates. Other effect is that they will use social services like govt. schools, hospitals etc. for which govt. has to bear the costs, which will lead to increase in taxes. Nation will also going to get affected by the trafficking and exploitation as the migrants smuggle people into it. About 140 people are being deported every month to Chennai from other countries or are being prevented from departing by immigration authorities in Chennai.176 In an extensive report about smuggling routes in Central Asia published in 2006, IOM noted that most of the smuggled migrants transiting through Central Asia come from Afghanistan, Bangladesh, China, India, Pakistan and Sri lanka.[1] Majority of Young kids are being trafficked to sold off to the mafia’s. Diseases, as most the immigrants will not undergo definite medical tests which will lead to carrying illness to our country also. Competition between jobs and opportunities will increase among immigrants and the other citizens.
