1. The petitioner-wife seeks transfer of HMA No. 1764 of
2024, titled as “Sh. Chanan Singh @ Raja vs. Smt. Harpreet Kaur @
Nancy”, filed by the respondent-husband under Section 13(1)(ia) of
the Hindu Marriage Act, 1955, seeking a decree of divorce. The
above-stated petition is pending before the Principal Judge, West
District, Tis Hazari Courts, Delhi and the petitioner-wife seeks
transfer thereof to the Court of Principal Judge, Family Court,
Patiala, Punjab.
2. As per the Office Report, service is complete on the
respondent – husband but no one has entered appearance on his
behalf so far.
3. Heard learned counsel for the petitioner and carefully
perused the material placed on record.
4. The petitioner-wife seeks transfer of the case mainly on
the grounds of financial difficulty and her inability to travel

5. Taking into consideration the hardships which are likely
to be faced by the petitioner-wife in contesting the case at Delhi
coupled with the fact that two cases, filed by the petitioner-wife,
under Section 144 of the Bhartiya Nagrik Suraksha Sanhita, 2023 and
under Sections 12, 17, 18 to 20, 22 and 23 of the Protection of
Women from Domestic Violence Act, 2005 are already pending before
the Family Court, Patiala, Punjab, we deem it appropriate to allow
the Transfer Petition.
6. The Transfer Petition is, accordingly, allowed and HMA
No. 1764 of 2024, titled as “Sh. Chanan Singh @ Raja vs. Smt.
Harpreet Kaur @ Nancy”, filed by respondent-husband under Section
13(1)(ia) of the Hindu Marriage Act, 1955, seeking a decree of
divorce, which is pending before the Principal Judge, West
District, Tis Hazari Courts, Delhi is ordered to be transferred to
the Court of Principal Judge, Family Court, Patiala, Punjab. The
records be forwarded to the Transferee Court forthwith.
7. As a result, the pending interlocutory application also
stands disposed of.
