1. This contempt petition has been filed alleging willful
disobedience of order dated 04.01.2024 passed in D. B. Civil Writ
(PIL) Petition No.20691/2023.
2. Though submission of learned counsel for the petitioner is
that the order of the Court is not complied with, from the reply of
the respondents it is revealed that as far as temporary huts are
concerned, that has already been removed and for removal of
pacca construction, after passing order under Section 91 of the
Land Revenue Act, 1956, notice was issued for removal and
towards that a letter was sent to the District Collector on
25.02.2025 for providing police force so that there may not be any
resistance over the removal of the encroachment.
3. Learned counsel for the petitioner has also disclosed to this
Court today during the course of hearing that person against
whom, the proceedings had been initiated and who were going to
be removed, has approached this Court by filing S.B. Civil Writ
Petition No.3142/2025, wherein there is an interim order passed
by this Court on 28.02.2025.
4. In view of the reply which has been filed by the respondents
and the disclosure made by the learned counsel for the petitioner,
this contempt petition cannot proceed and is closed.
