01. The complainant has filed the present case against

the accused alleging commission of the offence punishable

under section 138 of Negotiable Instrument Act.

02. In brief case of the complainant is as follows:-

The Accused no.1 is the Proprietor of the Accused

no.2 firm. One Saravanan was also the partner of the said

firm who is also the relative of the Complainant. In the first

week of April 2019 Saravanan approached the complainant

and requested him to invest money in the Accused no.2

which is doing the business of Trading, and also assured that

CC.NO.2926/2022

the firm will pay 0.75% interest per month and believing the

assurance, the complainant invested Rs.10,00,000/- in the

firm of Accused no.1 on 11-04-2019, out of the retirement

amount which he had received. The complainant withdrew

that much money from his bank account and invested the

money in the firm of the Accused no.1. Thereafter Saravanan

assured that the principal amount along with interest will be

paid after 5 months and the accused no.1 issued a post dated

cheque bearing no.155807 for Rs.10,00,000/- dated

08.09.2019 drawn on Axis Bank Ltd., Sathyamangalam-
